In September, the record industry came as close to a victory is it's going to get in 2009. Year-over-year album sales in the month were down only 5.9%, according to Billboard analysis of Nielsen SoundScan data. (For these purposes, September is defined as the four-week period starting August 31 and ending September 27.) September was the first month since April and only the second in 2009 with a single-digit decline in unit album sales. Year to date, album sales are down 13.7% versus 2008 and 31.4% versus 2007.

The music ringtone market is within the decline stage of its short life cycle, according to industry research firm IBISWorld. The company forecasts industry revenue to decline for the second consecutive year - down 15 percent from its $880 million peak in 2007 - totalling just $750 million in 2009.
Surging demand of digital albums and singles, worth an estimated $1.94 billion, are the reason behind the eroding mobile ringtone market. Early ringtones were bought via text and cost consumers up to $5 a song. Today songs can be purchased for less than a dollar now that mobile phones can connect to the Internet and music can be stored on memory like a computer.

Universal Music Publishing Group CEO David Renzer - "In the U.S. while we do get paid a mechanical (licensing fee) from ITunes, we are not getting any performance income from Apple yet. On iTunes you can stream radio, and you can preview (tracks), things that we should be getting paid performance income for."
National Music Publishers Association CEO David Israelite - "If you watch a TV show on broadcast, cable or satellite TV there is a performance fee collected," Israelite said. "But if that same TV show is downloaded over iTunes, there's not. We're arguing that the law needs to be clarified that regardless of the method by which a consumer watches the show there is a performance right."
Jonathan Potter Digital Media Association Exec - "First, publishers, composers and songwriters do get paid for music inserted into TV shows and movies. A production company must pay a "synchronization" fee for the right to include a song in any show or film. Then, once the show airs or the film is screened, the music guys will require a separate payment from TV networks or studios for performing the music publicly. Israelite confirmed this.

As previously reported, Apple is adding ringtones to iTunes. Until now, iTunes allowed customers to create their own ringtones from certain tracks sold on iTunes, but availability was extremely limited.The new $1.29 ringtones are "pre-cut" tracks from participating labels. The price point undercuts even the cheapest ringtones available from mobile operators, typically between $1.50 to $3. The ringtones are added to an iTunes service that has sold 8.5 billion songs in its lifetime, and Apple revealed there are 100 million iTunes accounts.

Universal Music Group's revenues of €2,009 million declined 1.7% compared to the same period last year. A 29% growth in digital sales and higher merchandising and music publishing activity was offset by falling demand for physical product and lower licensing income. Recorded music best sellers included new releases from U2, Eminem and Black Eyed Peas as well as Lady Gaga's debut album.
UMG continued its expansion beyond the traditional recorded music business in the period. Agreements were reached with YouTube to launch a music video service ("VEVO") and with Formula One to organize "F1 Rocks", a series of concerts. UMG acquired Frank Sinatra's international catalogue rights. Bravado, UMG's merchandising arm, entered into agreements with the Rolling Stones and the Michael Jackson estate.

The application will be free, but will require the user to have a premium Spotify subscription, which costs £10. The Swedish music streaming service is looked on as a rival to Apple's iTunes store because of its comprehensive, free library of millions of songs.

Island/Def Jam head honcho L.A. Reid announces the launch of his new publishing company L.A. Reid Music Publishing with a 50/50 ownership split with EMI Publishing according to the NY Post. His first venture in the pub game was under the Hitco Publishing brand which is home to writers like Beyonce and Sean Garrett to name a few so this is not new territory for the music industry vet. But as we all know it's all about timing and at a time where new digital platforms are popping up every week, generating revenue via catalog ownership is more important than ever.
Recording sales maybe down (that's why you're not reading about L.A. Reid starting a new record company) but that's only one stream out of many a writer can get paid off of the licensing of their music. You want to use my song in your new movie release? Pay me (synchronizing fee). You want to play my record on your online radio show? Pay me (performance fee). You want to use my instrumental to demo your song for label deal shopping purposes? Pay me (leasing fee). Add in mobile platforms, online streaming, satellite and the future possibilities can be nearly limitless. Is EMI on its way to biting the dust leaving the major leagues with only 3 players (Universal/Sony/Warner) or are they showing a strong hand with increased earnings? If you're referring to EMI the recording company then yes it's true the vultures are circling due to parent investment group Terra Firma struggles in getting its paper up to avoid defaulting on their Citigroup 'bailout' loan.
